*Trevor Ford represents car accident injury victims on a contingency fee basis,
which means you pay no fees until your case is resolved.
The standard fee is usually based on 30% of the recovery of damages.
Trevor Ford has negotiated thousands of car accident injury settlements for victims, including complicated multi-million dollar cases, and has argued cases at all levels of the Courts in Alberta. The most important aspect of any case is preparation. Meeting with an experienced Calgary car accident lawyer soon after an accident allows for the gathering of evidence from witnesses, police reports, photographs, video surveillance, and other sources which will form the basis of your case against the other side. In some cases, it may be necessary to hire an expert in accident reconstruction to prove fault.
The law of damages is based on the principle that the person at fault must restore the injured person to their original condition as best as money can provide. If you have lost the ability to work, you must be compensated for your loss of income. Likewise, you are entitled to compensation for the cost of any treatment you may require, past and future. Trevor will advise you regarding the different types of damages you are entitled to receive. He will also request all necessary records to establish and maximize your claim. If necessary, you may be referred to experts who will provide reports to support your claim for damages. Trevor will cover all costs relating to your case, and he will make sure that the responsible party pays these costs.
General damages for pain and suffering, disfigurement, and loss of enjoyment of life are determined by the particular circumstances of each motor vehicle accident case. In Calgary Alberta, the relevant factors include the nature of the injury, the injured person’s age, the severity and duration of the pain, the degree of disability, the loss of lifestyle, and comparison to damage awards in previous cases.
Many Alberta residents were unaware of the passing of the Minor Injury Regulations in 2004. Essentially, the regulations placed a cap on the amount of general damages that can be awarded for minor car accident injuries. Minor whiplash and injuries that do not result in serious impairment are included in the cap. Special damages, including loss of income and cost of treatment, are not affected by the regulations. Trevor can advise you if this law applies to your case. In many circumstances, the cap can be avoided by proving that you suffered an injury that is not covered by the regulations, such as a concussion, TMJ injury, or chronic pain. The best way to know if you have a good case is to call Trevor for a free consultation regarding your motor vehicle accident injury. Trevor can provide you with essential legal information and place your mind at ease.

Do I need a car accident lawyer if I only suffered a minor injury?
The law is confusing with respect to what a minor injury is. It is best to take advantage of a free consultation with Trevor to get advice on what types of damages you may be entitled to. Recently, we were retained by a young mother who had seemingly only suffered a minor whiplash in a parking lot sideswipe accident. Upon further questioning and review of the evidence, we were able to show that she suffered from a mild concussion or brain injury. Our client received a settlement in excess of $100,000.
Will I have to pay legal fees if my car accident injury case goes to court?
Trevor takes your car accident injury case on a contingency fee basis. This means that you will only pay a fee when you receive a settlement or judgment. The fee is calculated based on a percentage of the settlement. Although most cases are settled out of court, if your case proceeds to trial, you only pay a fee if you win.
Will a car accident lawyer pay the cost of disbursements?
In most car accident injury cases, Trevor will cover all disbursements. In the negotiation process, he will make sure the insurance company pays these costs as part of the settlement.
Can I still claim for injuries if I was charged by police?
The police have the discretion to lay charges at a motor vehicle accident scene. They consider factors such as the placement of vehicles, witness statements, traffic lights, traffic signs, etc.. The fact that you were charged, or even convicted, of a traffic offence does not prevent you from bringing a civil action for injuries. All of the evidence will be considered. You must prove on the balance of probabilities that the other driver was responsible for the accident. If there is evidence that you were partly to blame, your damages can be reduced accordingly. For example, if you were 50% to blame you may only recover 50% of your damages.
What if I was injured as a passenger in a car driven by a friend or family member?
If you have suffered injuries as a result of negligent driving, you are entitled to make a claim. Some people are hesitant to claim against a friend or family member because they feel it is morally wrong. When insurance companies determine what to charge for car insurance they factor in the risk of a passenger being injured in your car. They don’t exclude friends and family members. That means your friends and family members have been paying car insurance for a long time based partly on the risk that you might be hurt riding as a passenger in their car. If you decide not to make a claim against a friend or family member for that reason you are only benefitting the insurance company.
How much time do I have to file a lawsuit in a car accident injury case?
In Calgary, per the Limitations Act of Alberta, car accident injury claims must be filed at the Court within two years from the date of the accident. Failure to file in time will result in the loss of your right to make a claim. There are exceptions in the cases of minors and persons under disability.
